AnyProp Terms of Use

1. Scope and customer agreements

AnyProp, Inc. ("AnyProp," "we," or "us") provides MLS and other property data services to business customers. These Terms cover our public website at www.anyprop.com and our public documentation pages that link to these Terms, collectively the "Website."

The Website is intended for adults acting in a business capacity. By using the Website after receiving reasonable notice of these Terms, you agree to them to the extent permitted by applicable law. If you act for an organization, you represent that you have authority to act on its behalf.

Access to our APIs, data feeds, and other customer services requires a separate written customer agreement. That agreement and applicable data-source licenses govern those services, including fees, permitted data use, confidentiality, service levels, suspension, termination, liability, and dispute resolution.

These Website Terms do not independently grant access to customer services, supplement their commercial terms, or amend an existing customer agreement. If a customer agreement expressly incorporates website terms, that agreement determines the incorporated version, scope, and order of precedence. Posting an update to this page does not, by itself, amend a customer agreement.

Our Privacy Policy describes our handling of personal information. Acknowledging that policy does not replace any separate consent required by law.

2. Website use and content

You may use the Website to learn about AnyProp, make business inquiries, and review documentation. You may copy reasonable portions of our public documentation for internal evaluation or an authorized integration, retaining applicable notices. Code examples intended for integration may be adapted for that purpose, subject to any accompanying license and your customer agreement.

AnyProp and the relevant rights holders retain their intellectual property rights in Website content, software, branding, and documentation. Public availability does not authorize resale or republication of that content, use of our trademarks to imply endorsement, or access to underlying datasets beyond your authorized rights.

Do not use the Website unlawfully, misrepresent your identity or authority, attempt unauthorized access, bypass security or access restrictions, introduce malicious code, or interfere with its operation. Do not copy or redistribute content beyond the permission provided here, another applicable license, or applicable law. We may restrict Website access as reasonably necessary to address misuse, security concerns, or legal requirements; access to contracted customer services remains governed by the applicable agreement.

Public documentation, examples, and references to available data do not grant MLS or other source permissions. Availability of a field, media item, or dataset in an example does not authorize its use in a particular application. The applicable customer agreement and source license determine those rights.

3. Website information and availability

The Website provides general product information and technical guidance. Content, examples, and descriptions may change or contain errors. Product coverage and available fields depend on the applicable source, permissions, and customer agreement. Descriptions of planned features do not constitute a commitment to deliver them.

Website materials do not independently create service levels, support commitments, or warranties for contracted services. Any such commitments are determined by the customer agreement, including materials it expressly incorporates.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS INFORMATION ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NONINFRINGEMENT. We do not guarantee that the Website will be continuously available, complete, current, or error-free.

Information shown in examples may be incomplete or outdated. Independently verify information material to a transaction or decision. Website information does not replace a title search, appraisal, inspection, or professional legal, tax, or investment advice. This section does not limit commitments in a customer agreement or obligations that cannot lawfully be excluded.

4. Third-party links

The Website may link to third-party websites, documentation, or services. Those parties control their own content and practices. A link does not itself constitute an endorsement, and their terms and privacy policies apply to your use of their services.

5. Website liability

To the fullest extent permitted by law, AnyProp will not be liable for indirect, consequential, special, incidental, exemplary, or punitive damages arising from use of the Website, including resulting lost profits or business opportunities.

To the fullest extent permitted by law, AnyProp's total liability for claims arising from the public Website under these Terms will not exceed US $100. These limitations apply regardless of the legal theory of a claim. They do not limit liability for fraud, willful misconduct, gross negligence, or liability that cannot lawfully be limited.

These Website limitations do not replace or modify the liability provisions governing contracted customer services. Claims concerning those services remain subject to the applicable customer agreement.

6. Changes and general provisions

We may update the Website and these Terms. Updated Terms will state their effective date. We will provide additional notice or obtain acceptance where required by applicable law. Changes do not retroactively alter an existing dispute and do not amend a customer agreement except through that agreement's applicable amendment process.

If a provision is unenforceable, the remainder continues to apply to the extent permitted by law. Failure to enforce a provision is not a waiver. Nothing in these Terms excludes a mandatory legal protection or remedy, or liability for fraud or misrepresentation that cannot lawfully be excluded.
