AnyProp Privacy Policy

1. About this policy
AnyProp, Inc. ("AnyProp," "we," or "us") provides MLS and other property data to business customers through APIs and related delivery services (the "Services"). Access to the Services requires a separate written customer agreement. This policy describes our handling of personal information for our website, documentation, business relationships, sales inquiries, account administration, support, technical operations, and employee on-call SMS program. Section 3 explains how processing performed on behalf of customers or data sources is governed by the applicable agreements.
Our website and Services are intended for adults acting in a business capacity. We do not operate our customers' consumer-facing applications or provide those applications' services directly to their end users. Each customer is responsible for its own privacy practices, including the notices, consents, and choices required for its applications. This policy does not describe those practices or substitute for a customer's privacy notice.
This policy does not cover independent third-party websites. It does not serve as an employment privacy notice, except that Section 6 describes how we handle mobile information for our internal on-call alerting program.
2. Information we collect and why

We also use relevant records to prevent misuse, enforce our agreements, meet legal obligations, and establish or defend legal claims.
Please do not send us sensitive personal information, end-user credentials, or contact lists that we do not need, whether through inquiries, support materials, queries, or logs.
3. Licensed data and our processing roles
Our Services deliver licensed listing, member, and office records to paying business customers. MLSs and other authorized sources supply the underlying records, which can include real-estate professionals' names, brokerages, license numbers, email addresses, and telephone numbers.
We may normalize, combine, enrich, or derive fields to provide the Services. Access, permitted uses, recipients, and retention are subject to applicable source licenses and law. Providing a data feed does not authorize a customer to use its contents for every purpose.
When we process personal information on behalf of a customer or data source as its processor or service provider, the applicable agreement, any agreed data processing terms, and lawful instructions govern that processing. This policy does not replace or amend those arrangements or authorize additional uses of that information. The relevant customer's or source's privacy notice describes its purposes and practices. Our handling of information for our own business activities is described in this policy. Our obligations and individuals' rights under applicable privacy law continue to apply regardless of contractual arrangements.
The originating MLS or other data source generally maintains the underlying record. Corrections to source-supplied fields generally need to be made at that source. Privacy rights concerning information we process are described in Section 8.
4. Sales inquiries and follow-up
If you inquire about AnyProp or request a demonstration, we may use the email address or telephone number you provide to respond and to discuss our services. You can ask us to stop sales follow-up at any time by replying to the communication or by contacting us using the details in Section 11. Account, billing, security, and other service-related messages may continue where appropriate.
Submitting an inquiry does not enroll you in our internal employee on-call SMS program and does not, by itself, provide consent to automated marketing calls or marketing text messages. Any consent required for a particular type of communication is obtained separately.
5. Cookies, analytics, and advertising technologies
We use Google Analytics and Clicky to measure website visits and performance. Our website also includes a Google Ads tag for advertising measurement and related advertising features. These technologies can read or set cookies and collect page visits, referral information, browser and device details, identifiers, and interactions such as submitting an inquiry. Your browser sends technical information to providers, including its IP address, which can be used to derive approximate location. We may associate an advertising click identifier with an inquiry to understand which advertising led to it.
Google's advertising technologies can support audience creation and personalized advertising, depending on the features and settings in use. Google may combine information received from our website with information from other websites, apps, or Google services for measurement and advertising purposes, subject to applicable settings and permissions. You can restrict or delete cookies in your browser. Google provides a Google Analytics opt-out browser add-on for supported browsers and implementations, and Google Ad Settings for advertising preferences. These controls have different effects and do not necessarily stop server logs, all measurement, or all other collection.
On www.anyprop.com, the legacy browser "Do Not Track" signal does not by itself prevent analytics or advertising tags from loading. This signal is different from legally recognized opt-out preference signals such as Global Privacy Control, which are addressed in Section 8.
These controls supplement, and do not replace, rights available under applicable law. See Section 8 for privacy requests.
6. When we disclose information
We disclose personal information for the following purposes:
- Operating our business: to providers that support hosting, infrastructure, security, analytics, billing, customer support, and communications, as appropriate for their functions and subject to applicable legal and contractual restrictions.
- Website measurement and advertising: to Google, Clicky, and the providers involved in the technologies described in Section 5, for the purposes described there.
- Customer account administration: to authorized representatives of your organization in connection with its account and use of the Services.
- Data delivery: to authorized business customers receiving licensed real-estate information through the paid Services described in Section 3, subject to applicable source permissions.
- Data licensing: to an MLS or other data licensor when business contact or licensing information is needed to establish, maintain, or verify authorized access.
- Professional advice and legal obligations: to advisers and other recipients where reasonably necessary for legal, accounting, compliance, dispute, security, or fraud-prevention purposes, or to respond to valid legal process.
- Business transactions: in connection with a proposed or completed financing, merger, acquisition, reorganization, or transfer of business assets, subject to applicable law and appropriate confidentiality protections.
- At your direction: where you request a disclosure or provide consent.
- Employee SMS notifications: to messaging platforms, telecommunications carriers, and similar providers that help operate and deliver our internal on-call alerting program, as described below.
Employee mobile information and SMS consent. Mobile information collected for the employee on-call SMS program is not sold or shared with third parties or affiliates for marketing or promotional purposes. SMS opt-in records and consent are used to administer the on-call program and are not shared for unrelated purposes. We may disclose them to providers that operate or deliver the program and where legally required. The other disclosure categories above do not authorize marketing or unrelated commercial use of this information. Employees may reply STOP to opt out or HELP for assistance and may update or remove their number in the internal on-call tool. A confirmation message may follow an opt-out, and we may retain the records needed to document consent and honor the opt-out.
7. Retention and security
We retain personal information for as long as reasonably necessary for the purposes described in this policy, including applicable recordkeeping obligations and the establishment or defense of legal claims. Retention periods vary with the type of record, the customer relationship, operational and security needs, and applicable requirements. We retain privacy-request records as needed for compliance and dispute resolution. Retention of licensed real-estate information is subject to the applicable source license and law. Backup copies may remain until removed or overwritten through normal backup processes, subject to applicable deletion requirements.
We use reasonable administrative, technical, and organizational measures designed to protect personal information. No transmission method or information system can be guaranteed completely secure. Nothing in this policy limits any security, deletion, or notification obligation imposed by applicable law.
8. Your privacy choices and requests
Depending on your location, the information involved, and whether a particular law applies to AnyProp, you may have rights to access, correct, delete, or obtain a copy of personal information; withdraw consent; object to or restrict processing; or opt out of a sale, sharing, or targeted advertising covered by that law. These rights are subject to applicable conditions and exceptions.
These rights apply according to the actual processing involved, including where a disclosure described in Section 6 qualifies as a sale or sharing under applicable law. Nothing in this policy limits any other applicable privacy right or legal requirement to recognize an opt-out preference signal, such as Global Privacy Control.
To exercise an applicable privacy right, use the contact form in Section 11. Authorized agents may submit requests where permitted by law. We may request information reasonably necessary to locate records and verify identity or authority where permitted. We respond within the deadlines applicable law provides and give explanations where required.
If you disagree with our decision and an appeal right applies, you may appeal by replying to our response or by submitting a new request and identifying it as a privacy appeal. You may also contact the appropriate regulator in your jurisdiction.
We do not unlawfully discriminate against anyone for exercising privacy rights. Requests may be subject to legal exceptions, including required recordkeeping and the protection of the rights of others. Withdrawing consent does not affect processing that was lawful before the withdrawal.

9. Processing locations
Information may be accessed or processed in the United States and other countries where we, our personnel, or our providers operate. Privacy protections differ by location. Where applicable law requires safeguards for international transfers, those requirements apply.
10. Changes to this policy
We may update this policy to reflect changes in our practices or in applicable requirements. We will post the updated policy with a new effective date, and we will provide additional notice or seek consent where required by law.
